SMS TERMS OF SERVICE.

1. Program Description

Monday Coffee Club operates an SMS text messaging program that sends promotional and transactional messages to customers who have opted in. Messages may include but are not limited to:

• New drink announcements and seasonal menu drops
• Exclusive Monday Club member offers and promotions
• Order confirmations and status updates
• Special event notifications and location opening announcements
• Limited-time deals and birthday rewards

2. Opt-In & Consent

By providing your mobile phone number and checking the consent box (where applicable) or texting a keyword to our short code or long code, you expressly consent to receive recurring automated marketing SMS text messages from Monday Coffee Club at the telephone number you provided. Consent is not a condition of purchase. You must be at least 18 years of age or have parental/guardian permission to opt in.

You may opt in by:

• Providing your mobile number through our website signup form and checking the SMS consent box
• Providing your mobile number in person at any of our locations
• Texting a designated keyword (e.g., MONDAY) to our designated number

3. Message Frequency

Message frequency varies. You can expect to receive approximately 2–8 messages per month. You may opt out at any time (see Section 5 below).

4. Message & Data Rates

Standard message and data rates may apply to each message sent or received from us. These charges are determined by your wireless carrier and rate plan. You are responsible for all such charges. Monday Coffee Club does not charge for SMS messages, but your carrier’s standard messaging rates will apply.

5. How to Opt Out (STOP)

You may cancel the SMS service at any time by replying STOP to any SMS message from us. Upon sending STOP, we will immediately send you a confirmation message confirming your opt-out. You will receive no further SMS messages from us after opting out, except for transactional messages where required by law.

Monday Coffee Club is not liable for delayed or undelivered messages. Carriers are not liable for delayed or undelivered messages. We do not guarantee that any message will be successfully delivered to you. Wireless carriers may filter, block, or delay messages for any reason, and we are not responsible for any such actions by carriers.

8. Eligibility & Geographic Availability

Our SMS program is available to mobile subscribers in the United States with active service from participating wireless carriers. You must have a mobile device capable of sending and receiving SMS text messages. We do not support international numbers. If you change your mobile number, you must re-opt in to continue receiving messages.

9. Privacy & Data

We collect and process your mobile phone number and SMS message data in accordance with our Privacy Policy. We do not sell your mobile number or SMS data to third parties. Your information is used solely for the purpose of delivering SMS messages and improving our service.

We may share your mobile number and message data with our SMS service providers and carriers for the sole purpose of delivering messages. These providers are contractually obligated to protect your information and are prohibited from using it for any other purpose.

10. Your Responsibilities

• You must provide accurate and current mobile number information when opting in.
• You must be the owner or authorized user of the mobile device and number.
• You are responsible for all message and data charges incurred from your carrier.
• You agree to notify us if your mobile number changes or is deactivated.
• You agree not to use our SMS program for any unlawful or abusive purpose.

11. Program Suspension or Termination

We reserve the right to suspend or terminate your participation in our SMS program at any time, without prior notice, if we believe you have violated these SMS Terms, engaged in fraudulent or abusive behavior, or if required by our carriers or applicable law. We may also modify, suspend, or discontinue the SMS program in its entirety at any time without notice.

12. Compliance with CTIA & TCPA

Our SMS program complies with the Telephone Consumer Protection Act (TCPA) and the Cellular Telecommunications Industry Association (CTIA) Short Code Monitoring Council guidelines. We adhere to all applicable carrier requirements, including A2P 10DLC registration and campaign verification.

13. Changes to These SMS Terms

We may update these SMS Terms at any time by posting a revised version on this page and updating the “Last Updated” date. Your continued participation in the SMS program after changes are posted constitutes your acceptance of the revised SMS Terms. If material changes are made, we will notify you via SMS message prior to the changes taking effect.

14. Governing Law

These SMS Terms shall be governed by and construed in accordance with the laws of the State of Michigan, without regard to its conflict of law provisions. Any disputes arising under these SMS Terms shall be resolved in the state or federal courts located in Wayne County, Michigan.
